Thank you for accessing the website made available by Six Nines IT, LLC (“Company”, “we”, “us”, or “our”). We take your privacy very seriously. Our goal is to always be transparent and to explain in our privacy policy, in the clearest way possible, what personal information we collect, how we use it and what rights you have in relation to it.

All the personal information we have access to will be collected, processed and protected consistent with applicable data protection laws, including where applicable the General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act (“CCPA”), the California Privacy Rights Act (“CPRA“), and this privacy policy.

We never sell your personal information to any third party.  However, we do use some of the personal information that you provide when you access and use our website and any related tools and applications (the “Website”) for our own internal purposes, especially to help us manage our relationship with you and to improve our services, and we may share personal information with companies and individuals who provide services to us, all as described in this privacy policy.

We also participate in data co-ops, where we may share contact and statistical information about you to allow affiliates and fellow participants in those co-ops to offer their services to you.

If you browse our website, we use Google Analytics to understand and improve the quality and relevance of the content on our Website. This information does not reveal your specific identity (like your name or contact information).

A. Who is Covered by this Privacy Policy

This privacy policy addresses the use of personal information provided by visitors to our Website who visit for purposes of browsing and information.  Our privacy practices with regard to our employees, clients, and other third parties are addressed in separate agreements with those parties.

Six Nines IT provides a broad range of services to assist our clients to migrate their workload to the cloud and to optimize their use of Public Cloud Services, including engineering services, architectural services, management, configuration, security, and support of the consumption of Public Cloud Services.  The Website serves as a source of information for individuals who wish to know more about our services.

Our collection and use of personal information

When we use the term “personal information” in this privacy policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or de-identified information that is maintained in a form that is not reasonably capable of being associated with or linked to an individual (“Anonymized Information”).  You agree that Anonymized Information belongs to us and that we may use Anonymized Data for any legal purpose, subject to any provisions in our contracts with clients.

We collect personal information when you visit our websites or voluntarily submit information about yourself, such as when you register for a webinar or other benefit.

We collect the following categories of personal information that you provide in connection with our Website:

Contact Information. If you register for a webinar or other similar benefit or otherwise provide information to us through any paper or electronic applications or other forms, we will collect your name, phone number, and email address and possibly other demographic information.

Usage Data. Usage Data consists of the following and similar information:

  • Information about your interactions with the Website, which includes the date and time of any requests you make.  This also may include details of your use of third-party applications connected with the Website.

Data Acquired from Third Parties.  We may also acquire contact and other information from third parties, such as data co-ops or content syndication companies. We could potentially share first name last name and email address with partners.  We will only contact individuals whose personal information we have acquired in conformance with applicable law and will always allow these individuals to unsubscribe or opt out of any contact from us.

Cookies.  Like most companies, we use cookies and other data collection techniques to automatically collect information that helps us provide the Website and our services effectively.  We and our service providers use cookies, pixels, scripts and similar technologies to manage the website and to collect information about you and your use of the website. These technologies help us customize or personalize your experience and analyze the use of our Website and app to make them more useful to you.   • enforce our terms of service, including the investigation of potential violations thereof;

Please note that if you request that your personal information be removed from our databases, it may not be possible to completely delete all of your personal information due to technological and legal constraints.

Region specific disclosures

We may choose or be required by law to provide different or additional disclosures relating to the processing of personal information about residents of certain countries, regions or states. Please refer below for disclosures that may be applicable to you:

California Residents

California has also adopted the CCPA, which took effect at the beginning of 2020 and the CPRA, parts of which took effect on January 1, 2022.  We comply with the requirements of the CCPA and CPRA to the extent they apply to us. If you are a California resident and we qualify as a “business” under the terms of these laws, you will have the following rights:

You have the right to request that we disclose the categories of the personal information about you that we have collected, used, disclosed, shared, and/or sold during the last 12 months.  That information is disclosed above.  You also have the right to request the specific items of personal information about you that we have collected, used, disclosed, and/or sold during the 12 months prior to your request.

Further, you have the right to: (1) request correction of your personal information; (2) opt out of our use of or access information about our use, or lack thereof, of automated decision making technology; (3) restrict our use and disclosure of sensitive personal information (as defined in the CPRA); (4) request portability of your personal information

You also have the right to have the personal information we collect about you deleted, including our obligation to notify third parties about your request to delete your personal information.

We use a two-step process to verify your identity and to have the information deleted. Your rights to have personal information deleted are subject to several exceptions, specifically the personal information that is necessary for us to:

  • provide you a good or service;
  • protect your security and prosecute those responsible for breaching it;
  • fix our system in the case of a bug;
  • protect the free speech rights of you or other users;
  • comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
  • comply with a legal obligation; or
  • make other internal and lawful uses of the information that are compatible with the context in which you provided it.

We have listed the specific and general categories of personal information we have collected, disclosed, shared, or sold in the last 12 months in the sections above.

We do not sell your personal information directly, but we participate in data co-ops and similar arrangements, in which we may share your personal information with third parties who may use it to contact you to offer you their goods or services.

To make any request under the CCPA and CPRA, including to opt out of our sale of your personal information by completing the Data Request Form found at [INSERT URL FOR DATA REQUEST FORM PAGE]. You have the right not to receive discriminatory treatment by us for the exercise of any privacy rights conferred by the CCPA and CPRA, which means that we will not take any action to hurt or punish you for exercising your rights under the CCPA and CPRA.

Individuals Located in the EU/EEA

The General Data Protection Regulation made effective in Europe on May 25, 2018 (“GDPR”) requires that we clearly describe to data subjects (as defined in the GDPR) the data we collect and how we use that data.  This privacy policy does that, and we hope that if you have any questions for us regarding our data collection, you will write us at info@sixninesit.com.

The GDPR also requires that we have a lawful basis for our processing of any personal data about an individual residing in the EU (or EEA, as applicable). For an individual browsing our Website, our lawful basis is our legitimate interest in providing the Website to you in the manner that you desire, and all the personal information that we collect from such individuals will be used only for those purposes, as described in this privacy policy. For an individual purchasing products or services from us, our lawful basis is the contract under which you purchase those products or services, and the personal information we collect from such individuals will be used only in connection with our contractual relationship with you and only in a manner that furthers the purposes of that contractual relationship, as set forth in this privacy policy.

For employees and other authorized users operating in their role as administrators or users of our Website, our lawful basis is the legitimate interest we have in providing the services to their employer.

The GDPR also requires us to take appropriate technical and organizational measures to protect the security of personal information relating to residents of  the EU (or EEA, as applicable). Pursuant to the GDPR, residents of the EU (or EEA, as applicable) have the right to obtain our confirmation of whether we maintain personal information relating to them in the United States. If you are a resident of  the EU (or EEA, as applicable), upon request from you, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you, subject to our rights and obligations under the GDPR, as described in this privacy policy. You may also request portability of your data and you have the right to not be subject to decisions based solely on automated processing, including profiling, known as Automatic Decision Making. Individuals Located in the UK

To the extent the GDPR as incorporated into UK law pursuant to s.3 of the European Union (Withdrawal Act) 2018 (as amended, the “UK GDPR”) is different than the GDPR, we will follow all supplemental requirements under the UK GDPR and you have all rights as a UK citizen under the UK GDPR.
